Board Explorer Membership Terms and Conditions

Welcome to Board Explorer's Surfboard Rental Membership! By signing up for this membership, you agree to the following terms and conditions:

1. Membership Cost:

The cost of the Board Explorer Membership is $80.00 per month.

2. Surfboard Selection:

As a member, you have access to rent any used surfboard available in our shop.

3. Rental Period:

Your membership allows you to rent any of our used surfboards for the day as many times within that month as you'd like.

4. Billing Cycle:

Your billing cycle begins on the day you sign up for the membership and continues on the same day each month.

5. Payment:

Payment for your membership will be automatically deducted from the payment method you provided when signing up.

6. Cancellation Policy:

To cancel your membership, simply send us a message requesting cancellation. Cancellations shall be effected subsequent to the completion of a period encompassing three billing cycles.

7. Cancellation Terms:

If you cancel your membership, you will not be charged for the following billing cycle. However, if you cancel during a billing cycle, you will be charged for that cycle, and your membership will remain active until the end of that cycle.

8. Rental Terms:

Surfboards must be returned in the same condition they were rented, with normal wear and tear expected (such as pressure dings). Any damage beyond normal wear and tear may result in additional charges. If the renter causes damage exceeding one inch in diameter, fractures, or breaks the board, they shall be liable for the assessment of a fee.

9. Membership Changes:

We reserve the right to change the terms and conditions of the Board Explorer Membership with notice to members.

10. Stolen Board Clause:

In the unfortunate event of the surfboard being stolen while in the possession of the Renter, Board Explorer reserves the right to charge the Renter's provided payment method for the total amount of the board.

11. Injury Liability: 

By signing up for the Board Explorer Membership, the Renter acknowledges and voluntarily assumes all risks associated with the use of surfboards and related equipment. The Renter understands that surfing is an inherently risky activity and may result in accidents, injuries, or even death. 

The Renter agrees to waive any and all rights to bring legal action or file a lawsuit against Board Explorer, its owners, employees, agents, and affiliates for any injuries, damages, or losses sustained while using the surfboards or equipment provided by Board Explorer. 

The Renter agrees to hold Board Explorer harmless and release them from any liability for injuries or damages, whether caused by negligence or any other reason, to the fullest extent permitted by law. The Renter also agrees to indemnify and defend Board Explorer, its owners, employees, agents, and affiliates from any claims, demands, actions, or suits brought by third parties arising out of the Renter's use of surfboards or equipment. By signing this waiver, the Renter acknowledges that they have carefully read and understood this provision and voluntarily accept its terms. 

The Renter understands that this waiver of liability is a binding legal agreement and that they are giving up important legal rights." Please note that the specific wording of legal documents can vary based on jurisdiction and legal requirements. It is advisable to consult with a legal professional to ensure that any such clause in your waiver is legally valid and compliant with local laws and regulations.
